In Islamic jurisprudence and law, an option is defined as a right by virtue of which one or both parties to a contract, or a third person, may rescind the contract. According to the primary general rule, every holder of a right is entitled to waive his or her right; therefore, as a matter of principle, the waiver of all contractual options is permissible. This is because a right lies within the authority of its holder, and from a rational perspective, any form of disposition over one’s right is allowed. Moreover, Islamic law, as evidenced by Qur’anic verses and narrations (Qurʹanic verses and Prophetic traditions), explicitly affirms the validity of waiving rights. Furthermore, based on the Rule of Assumption (Rule of Initiative), the waiver of all options stipulated within contracts is considered permissible.
Conversely, in Imāmī jurisprudence and under the Iranian Civil Code, certain options are regarded as legal rulings (Legal provisions) rather than mere rights. Consequently, their waiver is deemed contrary to mandatory legal norms and, pursuant to the Rule of No Harm (Rule of No Harm), invalid. Ultimately, where a conflict arises between the Rule of Assumption (Rule of Initiative) and the Rule of No Harm (Rule of No Harm), the principle of justice requires that the Rule of No Harm prevail and take precedence. Therefore, an individual may waive the right to rescind a contract unless such waiver results in substantial harm to oneself or another person, in which case the Rule of No Harm governs and the waiver of that option is not permissible.
